Article 1 : Preamble
These conditions are concluded between, on one hand, Pepper mind sprl and, on the other hand, those wishing to purchase at the TYPHUS® website (www.typhus.eu) hereinafter referred to as "user". These conditions are exclusively for non-commercial individuals. The parties agree that their relations will be governed exclusively by this contract, excluding any condition previously available on the site. If a condition is found to be lacking, it would be governed by the procedures in force in the area of distance selling companies whose headquarters are in Belgium. Pepper mind sprl is committed to complying with all provisions of the Consumer Code relating to distance selling.
Article 2 : Application
These terms apply to any sale of the products presented on the site www.typhus.eu or any other site using the same sales interface. Any order placed with typhus.eu thus entails unreserved acceptance of these terms. Only the buyer can take advantage of these, including provisions relating to the guarantee. These terms may be changed at any time without notice by Pepper sprl mind, then the changes are applicable only to orders made after the date of implementation. These general sales conditions are available permanently on the site www.typhus.eu in computer formats for printing and/or downloading, so that customers can copy or save them.
Article 3 : Products
3.1 : Price - Postage
Prices are displayed in euros all taxes included, and excluding postage charges. They are subject to the Belgian tax on the value added and any change to the rate of this tax will not be reflected in the price of the products listed on the site www.typhus.eu at the date stipulated by the legislative or regulatory texts. The final sales price will remain the same everywhere (but the difference between the price tax excluded and tax included will vary depending on the value added tax of the country). Prices are subject to change at any particular time due to launch offers, promotions or sales. The cost of delivery charges is indicated before the confirmation of the order. These charges will not be refunded in case of cancellation of an order, already sent, and will be deducted from the refund made by Pepper mind sprl, which take place within 21 days of cancellation
3.2 : Availability
The products offered by Pepper mind sprl are only within the limits of available stocks. The periods of availability mentioned in the description of the products are indicative and depend on specific periods of suppliers and / or manufacturers. Under these conditions, the definitive unavailability or the possible report of any of those periods of unavailability do not in any way engage the responsibility of Pepper mind sprl, nor it can lead to any right for compensations or damages. In case of temporary unavailability of a product, Pepper mind sprl will inform consumers of the new deadlines communicated by suppliers and/or manufacturers of the product as soon as possible. If such unavailability continues excessively, Pepper mind sprl will strive to offer the consumer an equivalent product or, if failing, to undertake a refund in the form of vouchers or to proceed to the cancellation of the order and the refund of the consumer.
3.3 : Compliance
The products sold by Pepper mind sprl comply with standards applicable in Belgium. Items such as photographs, text, graphics and all information and features illustrating and/or accompanying the products are not contractual. Accordingly, Pepper mind sprl does not incur any liability for error or omission of any of these elements or any change of said elements by suppliers and/or manufacturers. The consumer is the judge of the compatibility of products ordered with the hardware already in his possession.
Article 4 : Conclusion of contract
In all cases, the sales contract is only deemed concluded from the flow of the consumer's account for credit cards or the date of receipt of money transfer in case of bank transfer.
4.1 : Order
The products offered for sale are displayed on the site www.typhus.eu and matched with a description. The consumer wanting to buy one of these products can follow the procedure to point 7 (see site). This product is added to his shopping cart. When the consumer intends to finalize his order, he can click on the button "order" contained in the confirmation page. He is then directed to a page providing a summary of all items of his next order, and at this stage he has the possibility of removing some of the items contained in the shopping cart. He also has the option to cancel the procedure and to come back to his shopping cart without validating the order. If the summary containing product prices and delivery charges suits him, customer can enter his shipping and billing addresses and then click on the logo of the bank of his choice in order to be directed to the secure server of that bank to make payment securely. The consumer's private banking information is therefore at no time in possession of Pepper mind sprl; preservation and maintenance of their integrity is therefore the responsibility of the bank. Once the payment is confirmed, Pepper mind sprl sends the customer a summary of his order by email including details of items ordered, the total price including VAT, the amount of shipping charges and delivery time considered.
4.2 : Payment
The customer must possess all the necessary permissions for use of the payment method he chose during the order validation. He also ensures its solvency before any order, otherwise Pepper mind sprl won’t be able to deliver ordered products. Pepper mind sprl keeps also the possibility of suspending or cancelling any order or delivery in case of refusal of payment authorization from the financial institutions contacted according to the method of payment chosen by the customer. Similarly, it leaves open the possibility of refusing to consider an order or make a delivery from a user with whom a dispute remains about the payment of a previous order. Consumers are also informed that Pepper mind sprl may proceed with the analysis and/or verification of orders to fight against fraud, and in this context reserves the right to request from customers any kind of information it deems appropriate. At the end of this procedure Pepper mind sprl can suspend or cancel any order or delivery, even if a payment authorization is issued by financial institutions concerned, where such analysis and/or these audits would to suggest that the order is placed in fraud of a third. It also does not bear any liability for malfeasance or fraudulent use of any means of payment that were not detected by this analysis and/or verification procedure.
Article 5 : Delivery
5.1 : Information
The products are delivered to the shipping address provided by the consumer when ordering online or offline. Where the delivery address is different from the billing address the consumer has to provide two separate addresses in the order. It is likewise the customer to provide any useful information on delivery at its command to enable carriers to make the delivery. In case of erroneous or incomplete information resulting in the inability of the carrier to make the delivery, a second delivery will be made after the return of the goods to Pepper Mind sprl, but only after advance payment of the amount of new charges by the customer.
5.2: Delivery if absent
The products ordered are delivered in the mailbox of the customer if it allows it. If not, a notice of passage is left so that the customer can retrieve his order in the post office of his area. In case of refusal of delivery by the customer, he will be refunded the amount of the order minus the shipping charges incurred by the delivery increased by the charges caused by the refusal.
5.3 : Delay - Loss
Each carrier undertakes on-time delivery and is solely responsible for its observation. In case of failure to respect these deadlines, the customer has to contact first the carrier concerned to ensure that goods ordered are not the subject of a pending. In case of delay or difficulty in locating the products ordered, consumers can contact Pepper Mind sprl will help to locate the package eventually lost by the carrier. The customer has to send an e-mail to info@typhus.eu and provide all relevant information including the purchase order to enable it to attempt to locate the ordered products. In such case, Pepper mind sprl is dependent of delays imposed by carriers for the statement of loss and return of the shipment. These delays may vary depending on carrier. No refund can therefore take place for the customer before the carrier has reported the products as lost at the end of its investigation. As soon as the declaration of loss is made by the carrier, Pepper mind sprl will refund, exchange articles or provide discount coupons to the customer.
Article 6 : Deadline for withdrawal
The consumer has a cooling off period allowing him to waive his purchase within 15 days from delivery, pursuant to the articles of the code of consumption for Typhus ® product range. Any customized product will in no case be part of this agreement, as it is a specific request of the customer. It is imperative to share in advance of his intention to return the package within the exercise of its right of withdrawal to the email address info@typhus.eu. The delivered products must be returned to Pepper mind sprl at the consumer's expense and under his responsibility, also in matters of transport insurance, in perfect resales conditions and in their original packaging. Subject to compliance with the provisions above, Pepper mind sprl will refund the ordered products according to the amounts on the order, excluding postage, within 15 days of receipt of goods. No refunds will be made if the goods are not perfectly intact.
Article 7 : Returns
Transport risks are entirely endorsed by the sender, and he must therefore take care of delivery safety, including through its dispatch. Return costs are entirely borne by the sender, except when the return is motivated by an error of Pepper mind sprl in preparing the order.
Article 8 : Guarantees
In case of defective product the customer will make its return under the conditions set out in Article 7 of these terms. The damage caused by misuse of the product or by an external cause (such as breach of washing conditions) does not give rise to a warranty. The provisions of this article shall not deprive the consumer of the legal guarantee of the Consumer Code.
Article 9 : Privacy
Under the laws of the Internet the users have the right to access and rectify any personal data. These data are only provided in order to proceed to the delivery of goods ordered via the website, by fax, phone or mail. They are required to process orders and checks may be made to fight against fraud. If optional data should be collected, the consumer will be advised of this optional. He is informed that the refusal to provide mandatory data has consequences for the failure to make delivery of the products he would like to order. He is also informed that, as part of the verification of information provided with the order, the data can be transmitted to third parties for the sole purpose of verification. The consumer has the opportunity to oppose the possible transfer to a third of personal data, except to third parties responsible for verification of mandatory data provided in the order. This opposition may lead to the impossibility to treat his order.
Article 10 : Force Majeure - Applicable Law
The mutual obligations arising from these conditions are likely to be suspended in case of occurrence of a fortuitous event or force majeure. Will be considered as including those usually retained by the jurisprudence of the Belgian courts and tribunals. These general conditions are subject to Belgian law regarding the substantive rules as rules of form. Any dispute will have to be the object of an attempt of amicable settlement.
Article 11 : Copyright
To use logos, patterns, designs, slogans, texts in your designs or personalizations you must have permission or be the author thereof. Feel free to get information on copyright and reproduction. You can ask for an authorization restricted within the framework of a private use.
By sending a pattern in the operating room of T-shirtologie, you certify that you have permission to reproduce it, you take full responsibility in case of complaint of the author and take all the penal consequences.
